<p>If you don&#8217;t have the original agreements this is not a problem as we can apply for them.</p>
<p>You would have a one off payment of £295 to have your agreement checked by our legal team, if you have a second agreement the cost to have that one checked would be £195, all subsequent agreements would be checked at a cost of £95. <span style="color: #ff0000;">These fees are now refundable less a £50 admin fee if you do not have an unenforceable agreement.</span></p>

<p>When we receive your agreements they are checked by our solicitors to see if they comply with the prescribed terms of the 1974 Consumer Credit Act.</p>
<p>If they are deemed unenforceable for any reason you will be notified and a claim can be commenced on your behalf with no extra charge to you.</p>
<p>You will receive 100% of your claim you do not pay us any commission.</p>

			<content:encoded><![CDATA[<p><strong>What is an unenforceable Credit/Loan Agreement?</strong></p>
<p>The main reason an agreement would be unenforceable would be something wrong with the way the agreement had been written but even if there are no flaws in an agreement it may be possible to claim due to “Unfair Relationships” this would depend on your circumstances at the time, things like how many credit cards you have at the time or did you have loans in existence when your agreement was signed and if you were in a position to repay everything could be taken in to consideration. If an agreement is deemed to be unenforceable it would not be necessary to pay any outstanding balance</p>
<p><strong>Can I reclaim all of my previous Payments?</strong></p>
<p>If your agreement is unenforceable the outstanding balance will be written off, with regards to previous payments this would depend on which aspect of the Consumer Credit Act your lender has not complied with, in many cases previous payments may be reclaimed.</p>
<p><strong>Will the lender try to take me to court?<br />
</strong><br />
No they will not because it is the lender who hasn’t complied with the law not yourself, you are only exercising your consumer rights. Our solicitors will deal with the lenders directly, if your lender tries to contact you it is not necessary to engage in conversation with them, merely direct them to the solicitors.</p>
<p><strong>If I claim how will this affect my credit rating?<br />
</strong><br />
When your loan has been written off, the information on your credit report will appear the same as if you had paid the amount in full, your lender and Credit Reference Agencies are not allowed to enter any negative information on your credit report.</p>
<p><strong>Will this affect any loan or credit card applications I make in the future?<br />
</strong><br />
No because your credit rating will still be the same as it was before, he you apply to the same lender again there is a possibility they may not want you as a client again.</p>
<p><strong>Can I stop making repayments once your solicitors have taken on my case?<br />
</strong><br />
If you want to keep your credit rating the same as it was before you commenced the claim you must continue to make the repayments until you receive written confirmation telling you to stop making the repayments.</p>
